Taxpayers’ Bill of Rights Hearing Summary Taxpayers’ Bill of Rights Annual Report to the Legislature
The Taxpayers' Bill of Rights Act requires FTB to conduct an annual hearing before the three-member Board where tax professionals, industry representatives, and individual taxpayers are allowed to present their proposals on changes to the personal income tax or franchise and corporation tax laws, as well as changes to administrative procedures. FTB typically holds the hearing in December.
Matters raised at the December 2024 Taxpayers' Bill of Rights Hearing, include the following:
- Encouragement for FTB to announce major changes affecting taxpayers and practitioners as soon as possible.
- Request for FTB to provide Chief Counsel Rulings and other guidance, or promulgate regulations where appropriate, as quickly and as often as possible to clarify uncertain legal areas and mitigate potential penalties.
- Request for FTB to share trend data on filings of state Form 3840, California Like-Kind Exchanges. (The form is filed when California real property is exchanged for like-kind property located outside the state, under IRS Code Section 1031).
