Tax Professional: How To Submit a FTB 3520 (PIT or BE), Power of Attorney Declaration

To submit a Power of Attorney Declaration, online, log in to MyFTB and follow the “How To” instructions below. If, once you’re logged into MyFTB, you need help with the page you’re on, select the “?” in the upper right corner of that particular page. If you need help with deciding what information to add to the online form, refer to the paper form's instructions for 3520 PIT or 3520 BE.

Note: FTB no longer revokes prior overlapping POAs. Do not attach a copy of any prior POA the taxpayer wants to remain in effect.

Note: You can also submit a POA Declaration by selecting File a Power of Attorney from the Services dropdown menu or from your homepage.

Select the File a Power of Attorney Button
  • Select type of Taxpayer for the POA Declaration.
    Note: Selecting Estate/Trust will require attaching a signed declaration.
  • Select the Next button.

  • Enter the taxpayer information.
    * = required field
  •  Select the Save button.
Enter Taxpayer Information
  • Review the contact information listed for the taxpayer.
  • Select the Edit button to edit information, if applicable.
  • Select the Next button.
Review Taxpayer Information
  • Select the Edit button to review and edit your representative information for the declaration, if necessary.
    Note: If you want to receive email notification when we send your client a notice to an email address other than the one used when you registered for your MyFTB account, select the Edit button and enter the new Email address.
  • Select the Add New Representative button to add additional representatives to the declaration, if applicable.
  • Select the Select from the Associates List button to choose other representatives that you previously added to your Associates List. When you select a representative from your Associates List, their information is automatically populated on the POA wizard for you.
  • Select the Next button.
Edit Representative Information
  • Select the All Years checkbox or the Specific Years checkbox.
    • If you select All Years proceed to Step 11.
    • If you select Specific Years, you will be prompted on the next page to enter the Specific Years to be covered by this POA. Proceed to Step 9.
  • Select the appropriate checkboxes for Additional Authorizations, if applicable.
  • Select the Next button.
Assign Privileges
  • Enter the specific years to be covered by the POA.
  • Select the Add button.
Select Applicable Tax Years
  • Review income periods covered by the POA declaration.
  • Select Add to include additional income periods.
  • Select the Next button.
Review Summary of POA Declaration and Selection Authorization Option
  • Review the information on the Summary page. 
    • To edit information use the Back button at the bottom of the page.
  • In the Authorization of POA section, select an option for Taxpayer Authorization.
    • If you select I am attaching taxpayer’s authorization, a signed POA declaration is required. Proceed to Step 13.
    • If you select I am not attaching the taxpayer’s authorization, select the Submit button.
      • After FTB review, the taxpayer must approve the declaration online through their MyFTB account.
Note: After you submit the POA, it displays as “Pending” in your Client List. After FTB reviews the POA, a copy is sent to your client’s MyFTB Account for their approval. Once the taxpayer approves the POA, it displays as “Active” in your client list. Review Summary of POA Declaration and Selection Authorization Option
  • Note the POA Declaration number listed.
  • Select the Return Home button to navigate back to the homepage.
Confirmation of POA Submission
  • In the Authorization of POA section, select I am attaching taxpayer’s authorization.
  • Enter the Printed Name and Date from Part 5 of the signed POA declaration.
  • In the Attachments section, select the Add Attachments button to add a signed copy of the declaration.

Note: You must attach:

  • A signed POA declaration that matches exactly the details you submitted online.
  • A copy of any POA the taxpayer wants to remain in effect. FTB will revoke all prior overlapping POAs not attached.

  • In the Attachments section, select the Upload button.
    • You can attach up to 10 documents, not to exceed 10 MB. Valid file extensions are pdf and xlsx.
    • In the pop-up window, browse and select the appropriate file and select the Open button.

  • The uploaded file displays in the Attachment column.

  • Select the Submit button.

Note: As soon as you submit the POA declaration, it displays as “Pending” in your client list. After FTB processes the POA and the 10 business day waiting period has lapsed, it displays as “Active” in your client list.

Submit the Declaration
  • Note the POA Declaration number listed.
  • Select the Return Home button to navigate back to the Home page.

Note: An acknowledgment letter will be sent to the taxpayer advising them that Franchise Tax Board has rejected or approved a POA Declaration allowing you access to view their tax account information online. The letter will include your individual name (we are not able to add a company or firm name). We recommend you notify your client that they will receive this letter from us.

You will receive email notification and can check the POA status on MyFTB.
