Tax Professional: How To Submit a FTB 3520 (PIT or BE), Power of Attorney Declaration

The preferred method to submit a Power of Attorney (POA) Declaration to Franchise Tax Board (FTB) is on MyFTB using the POA Wizard. If you need specific information on how to complete Form 3520 (PIT or BE), refer to the form’s instructions.

To submit a Power of Attorney Declaration:

  • Log in to your MyFTB Tax Professional account.
    • Once you’re logged into MyFTB, if you need help with the page you’re on, select the “?” in the upper right corner of that page.
  • Select Client List from your Main Navigation Menu or the Quick Links section on your Tax Professional Overview page.
  • Follow the “How To” instructions below.

Note: You can also submit a POA declaration by selecting File a Power of Attorney from the Services dropdown menu from any page or select the File a Power of Attorney link from your homepage.

Select the File a Power of Attorney Button

  • Select a radio button for the Type of Taxpayer.
  • Select the Next button.

Note: Selecting Fiduciary (Estate or Trust) or 540 NR Group Nonresident Return will require attaching a signed POA declaration.

  • Select a radio button for the Type of Taxpayer.
  • Select the Next button.

Select the Yes button in the Important Tips window

  • Enter the Taxpayer Information.
    * = required field
  •  Select the Save button.

Enter Taxpayer Information

  • Review the contact information displayed for the taxpayer.
  • Select the Edit button to edit information, if applicable.
  • Select the Next button.

Review Taxpayer Information

  • Select the Edit button to review and edit your Representative Information for the declaration, if necessary.

Note: If you want to receive email notification when we send your client a notice, to an email address other than the one used when you registered for your MyFTB account, select the Edit button and enter the new Email Address.

  • Select the Add New Representative button to add additional representatives to the declaration, if applicable.
  • Select the Select From Associates List button to add additional representatives from your Associates List to the declaration, if applicable. When you select a representative from your Associates List, their information will automatically populate. See How To Manage My Associates List.
  • Select the Next button.

Edit Representative Information

  • Select the applicable Authorization for All Years or Specific Years Your POA Declaration Covers checkbox:
    • All Years checkbox (includes prior, current, and future years up to the expiration date of the POA declaration), skip to Step 10.
    • Specific Years checkbox (specific years designated).  
      • Enter specific years or income periods on the following page.
      • Continue to Step 8.
  • Select the appropriate checkboxes for Additional Authorizations, if applicable.
  • Select the Full or Limited radio button to request your level of online account access to information in your client’s MyFTB account.
    • When we approve the POA declaration, you will automatically have Limited Online Account Access to information in your client’s MyFTB account for the years designated on the declaration. For more information about what you can view or actions you can take for each access level, see Online Account Access Levels.  

Be Advised: This online account access level will apply to this POA and all POA and TIA relationships you have with this client as well as all relationships other representatives listed on this declaration have with this client.

  • Select the Next button.

Assign Privileges

  • Review specific income periods to be covered by this POA declaration.
  • Select Add to include additional income periods.
  • Select the Next button.

Review Summary of POA Declaration and Selection Authorization Option

  • Review the information on the Summary page. 
    • Select the Edit (Taxpayer, Representative, or Authorizations) Information link in the applicable section if you need to update the information.
  • In the Authorization of POA section, select an option for Taxpayer Authorization.
    • I am attaching taxpayer’s authorization - a signed POA declaration is required, skip to Step 12.
    • I am not attaching the taxpayer’s authorization, select the Submit button.
        • After FTB reviews the POA declaration, we will notify your client that a POA declaration is pending their approval in MyFTB.

          Note: The POA will display as “Pending Taxpayer Approval” on your Client List. We will only notify your client that they have a Pending POA declaration that requires their approval, if they have a MyFTB account. Once your client approves the POA declaration, it displays as “Active” on your Client List.

  • Select the Submit button, continue to Step 11.

  • Note the POA Declaration number displayed.
  • Select the Return Home button to navigate back to the homepage.

Note: We will notify you and your client once we process the POA declaration and it becomes “Active” or it is “Rejected”. Inform your client to expect this notification. You can also check the status of the POA declaration on MyFTB.

Confirmation of POA Submission
  • Enter the Printed Name and Date Signed from Part 5 of the signed POA declaration.
  • Select the Add Attachments button in the Attachments section to attach a signed copy of the POA declaration.

Note: To provide your client’s authorization with the POA declaration, you must attach a signed POA declaration that exactly matches the details you entered online.

  • Select the Upload button, in the Attachments section.
    • You can attach up to 10 documents, not to exceed 10 MB. Valid file extensions are pdf and xlsx.
    • In the pop-up window, browse and select the appropriate file and select the Open button.

  • The uploaded file displays in the Attachment column.
    • Select the Remove link in the Action column if you need to delete the attachment.
  • Select the Submit button.

Note: After you submit the POA declaration, it displays as “Pending” on your Client List.

  • Select the Return Home button to navigate back to the Home page.

Note: We will notify you and your client once we process the POA declaration and it becomes “Active” or it is “Rejected”. Inform your client to expect this notification. You can also check the status of the POA declaration on MyFTB.
