Inland Empire Tax Preparer Pleads Guilty to Filing False State Income Tax Returns

An Upland tax preparer pleaded guilty Wednesday to four felony counts of filing false state income tax returns, the Franchise Tax Board (FTB) announced.
Jose A. Garcia, 29, owned and operated Mi Oficina Income Tax, a tax preparation business with several locations throughout the Inland Empire. According to court documents, Garcia prepared false personal state tax returns for tax years 2001 through 2004 and underreported his income for these years by more than $968,000. Garcia owes the state $310,369 representing the unpaid tax, penalties, interest, and the cost of the investigation.
Garcia’s sentencing is scheduled for April 2 in Department S23 of the San Bernardino Superior Court. Full restitution is expected to be ordered with the $292,687 that was seized during a search of Garcia’s offices being applied to his balance due.
San Bernardino County Superior Court Judge Michael Dest presided over the case. San Bernardino County Deputy District Attorney Melinda Spencer prosecuted the case.
