Child Victims of Human Trafficking Fund

Purpose of Bulletin
To inform staff that the Child Victims of Human Trafficking Fund has expired but was inadvertently included in the Voluntary Contribution section of 2016 Forms 540, 540 2EZ, 541, and 540NR Long and Short.
The Child Victims of Human Trafficking Fund statutorily expired at the end of 2015. The fund should have been removed from all tax returns for the 2016 tax year.
Revised forms were uploaded to the FTB website on March 17, 2017.
Computerized Tax Processers were notified on March 17, 2017, so they could update their tax preparation software.
Taxpayers who have already filed and donated to the fund on their 2016 tax return may receive an additional refund.
Taxpayers who receive an additional refund will also be sent a letter explaining the situation.
A TI system update will be implemented March 29, 2017, to disallow contributions for returns filed on that date forward. Those taxpayers will receive a notice with paragraph code ** indicating we did not process their contribution.
If you are contacted by a taxpayer who receives a letter regarding the additional refund or adjustment to their account:
- Explain that the Child Victims of Human Trafficking voluntary contribution fund has expired and contributions are no longer available on the form.
