Calendar year taxpayers affected by the 2011 Governor's Proclamation declaring disasters in Santa Cruz, Los Angeles, San Bernardino, and Mendocino Counties, must file returns to make their election to take a loss deduction in the 2010 year on or before October 15, 2012.
Specifically, California legislation was passed that allows affected taxpayers until the extended due date for the 2011 taxable year's return to elect to file an amended return for the prior (2010) taxable year to deduct the disaster losses in the prior (2010) year.
